Florida Firearm Myths: Fact or Fiction?

Myth #1: “If you can legally carry, you can carry anywhere.”

Fiction.

Even someone who is legally carrying isn't automatically authorized to carry everywhere.

Florida law identifies locations where concealed weapons or firearms are prohibited, including certain government facilities, courthouses, detention facilities and other specifically designated places.

Myth #2: “Florida allows open carry of firearms.”

Fiction under the current general rule.

Florida's current statute generally prohibits openly carrying a firearm on or about your person, subject to specific exceptions.

Bottom line: Don't assume that because concealed carry may be lawful under certain circumstances, open carry is automatically lawful too.

Myth #3: “If you have a concealed weapon license, you don't have to worry about identification.”

Fiction.

Florida law requires a person who is actually possessing a concealed weapon or concealed firearm while licensed to carry valid identification and to display it upon demand by a law enforcement officer.

There are also identification requirements for people carrying concealed without a license under Florida's statutory authorization.

Myth #4: “Florida firearm laws never change.”

Definitely fiction.

Florida's firearm statutes can be amended by the Legislature, interpreted by courts and affected by changes in federal law. Recent developments demonstrate just how quickly things can change.

The current FDACS notice specifically says the Fourth District Court of Appeal ruled on June 17, 2026, inEubanks v. Florida, and FDACS will issue concealed weapon licenses to applicants 18 or older who satisfy the other eligibility requirements.

Bottom line: Check the date and source of your information.

Myth #5: “Having a firearm means you automatically know how to use it safely.”

Fiction.

Owning a firearm and being proficient with it are two different things.

Responsible ownership includes learning the fundamentals of safe handling, understanding how your particular firearm operates, practicing in an appropriate environment and periodically refreshing your knowledge.

For new owners especially, professional instruction can be an excellent way to build safe habits.

Bottom line: Education doesn't end when you purchase a firearm.

Myth #6: “A firearm is secure just because it's hidden.”

Fiction.

Hiding a firearm isn't the same thing as securely storing it.

Responsible storage should be designed to prevent unauthorized access, particularly by children and other people who should not have access to the firearm. Depending on your circumstances, that might involve a safe, lock box or other appropriate locking device.

The Biggest Myth of All?

“I heard it from someone who knows guns, so it must be true.”

Even experienced firearm owners can have outdated information.

The safest approach is to:

  • Check thecurrent Florida Statutes.

  • Review information from theFlorida Department of Agriculture and Consumer Services (FDACS).

  • Check applicable federal requirements.

  • Ask a qualified attorney when you need legal advice.

  • Keep up with changes rather than relying on something you learned years ago.
